User offer of Yantar.ua online service

According to the current Ukrainian legislation, trade through an online store is distance trade. Contractual relations between the buyer and the seller are drawn up in the form of a public offer contract. Clicking on the PAY button in the online resource on the CALCULATIONS registration page means that the buyer, regardless of status (individual, legal entity, natural person – entrepreneur), in accordance with current Ukrainian legislation, has accepted the terms of the public offer contract, which are specified below .

The public offer contract is public, that is, according to Article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers regardless of status (individual, legal entity, natural person – entrepreneur). In full agreement with this Agreement, the buyer accepts the conditions and procedure for placing an order, paying for the goods, delivering the goods, responsibility for an unscrupulous order and for non-fulfillment of the terms of this agreement.

The contract is considered concluded from the moment of pressing the PAY button on the order page and confirmation of its purchase.

If necessary, at the request of the buyer, the contract can be executed in writing.

Essential terms of the public offer contract

1. Terms of the agreement
1.1 Terms of the agreement – this definition is present in this contract and is an integral part of it.
1.2 Definitions are interpreted based on their essence and content of this contract. Below is a list of these definitions:
Yantar.ua – Marketplace, online store.

Product – the object of the agreement of the parties, which was chosen by the buyer in the "Yantar Polissya" online store; and placed in the online store basket.
Buyer – any able-bodied natural person, legal entity, natural person-entrepreneur, in accordance with current Ukrainian legislation, who has visited the Yantar.ua website, intending to purchase one or another product, and to pay for the receipt of such product.
Seller – FOP Viktoriya Viktorivna Slobodanyuk according to the contract, the owner of the goods offered on the website of the online store.

2. General provisions
2.1 This public offer (hereinafter – the contract) defines the specifics of buying and selling goods on the Yantar.ua website.

This offer applies to any product offered for sale (purchase) on the Yantar.ua site.

3. The subject of the public offer contract.
3.1 Providing the Buyer with access to all necessary information about the Product (which confirms the quality and safety of its use), presented as part of the Yantar.ua project.

4. The moment of concluding the contract.
4.1 The text of this Agreement is a public offer and is valid for all visitors of the Yantar.ua online store who have the intention, desire and opportunity to purchase goods that do not contain components of animal origin.
4.2 Acceptance of the offer – purchase of the goods in the order provided for in this contract, at the prices indicated on the Internet resource Yantar.ua and agreement with the terms of payment and delivery of the goods.
4.3 The fact of purchasing the Goods is the unconditional acceptance by the Buyer of the terms of this Agreement.
The buyer who used the services of Yantar.ua is considered as a person who has entered into contractual relations with the Seller.

5. Rights and obligations of the parties.
5.1 Yantar.ua undertakes – deliver the goods to the Buyer.
The goods must be handed over: in a certain place together with other devices and documents related to the goods in a certain quantity in the appropriate completeness and in a set, if such are provided of proper quality free from claims of third parties. The Seller undertakes to inform the Buyer of the necessary and reliable information: information about the manufacturer, and information about the product.
5.1.1 From the moment of concluding this Agreement, fully ensure all obligations to the Buyer in accordance with the conditions discussed collectively by the Yantar.ua website and this agreement. Yantar.ua reserves the right to default in the event of force majeure.
5.1.2 Not to disclose any private information about the Buyer and not to provide access to this information to third parties, except for cases provided by law or at the request of the Buyer.
5.2. Yantar.ua has the right:
5.2.1 Change the terms of this Agreement, as well as Tariffs (prices) for Goods and services, unilaterally, by posting them on the website at the address: Yantar.ua
5.2.2 All changes take effect immediately upon publication.
5.3 The buyer undertakes:
5.3.1 Before concluding the Agreement, familiarize yourself with the content of the Agreement, the terms of the Agreement and the tariffs (prices) offered by the Seller on the pages of the Yantar.ua website
5.3.2 In order for the Seller to fulfill his obligations to the Buyer, the latter must provide all the necessary data that clearly identify him as the Buyer and are sufficient for the delivery of the paid Goods to the Buyer.

6. DISCLAIMER OF WARRANTIES.
6.1 The Seller does everything possible to ensure quality provision of services to the Buyer. Verbal advice and information given to the Buyer cannot be considered as guarantees.
6.2 The parties are released from responsibility for non-fulfillment or improper fulfillment of obligations under the Agreement during force majeure. Force majeure means extraordinary and irresistible circumstances under the given conditions that prevent the parties from fulfilling their obligations under this Agreement. These include natural phenomena (earthquakes, floods, etc.), circumstances of public life (military actions, states of emergency, major strikes, epidemics, etc.), prohibitive measures of state bodies. During this time, the parties have no mutual claims, and each party assumes the risk of the consequences of force majeure.

7. PRODUCT PRICES.
7.1 Prices for Goods and services on the Yantar.ua website are determined in the relevant sections of Yantar.ua
7.2 Prices for Goods and services may change depending on market conditions.
The Seller cannot change the price for a specific Buyer, if he has already accepted the Seller's terms and made the payment for goods (services) established by this contract.

8. OFFER VALIDITY TERM.
8. This contract enters into force from the moment of application to the INTERNET SHOP «Yantar Pol issia» at the address Yantar.ua and placing the ORDER, and ends with full fulfillment of obligations by the Parties.

8.2 The offer may be withdrawn by the Seller at any time, which is not a reason for waiving obligations for already completed sales.

9. DELIVERY OF GOODS.
9.1 The Buyer receives the Product via delivery from the "Yantar Polissya" online store, or receives it in person. The order of payment and receipt is specified in this offer contract.
9.2 When delivering goods to other cities of Ukraine, which is performed by various delivery services under the terms of cooperation.
9.3 Shipment of the Buyer's order takes place after receipt of 100% of the invoiced payment from the Buyer.
9.4 The fact of receiving the goods and the absence of claims to the quality of the goods is confirmed by the Buyer by receiving a receipt upon receipt of the goods. For its part, FOP Slobodanyuk V.V. from "Yantar Polissya" guarantees the shipment of the goods to the carrier company in the quantity indicated and paid for by the Buyer, in completeness according to the specification of the goods and in proper condition and quality.
9.5 Payment of the delivery cost is made by the Buyer to the carrier company independently, at the time of delivery of the goods. The exact cost of delivery is determined by the carrier company and announced by the company's courier upon delivery of the goods to the buyer. The cost of delivery includes the tariff for transportation according to the carrier's current price, insurance and the cost of return delivery of the invoice signed by the Buyer. Employees of the online store, at the request of the Buyer, can tell the Buyer the approximate cost of delivery for informational purposes only.
9.6 In the event of the absence of the Buyer at the delivery address specified by the Buyer in the application or the Buyer's refusal for a reason different from that specified in Clause 9.7 from receiving the goods upon delivery by the courier of the Carrier Company, the goods are returned to the Seller. Payment for the services of the Carrier Company is deducted from the amount paid by the Buyer for Yantar.ua goods. The balance of the amount is returned to the Buyer on the basis of his letter sent to the address: info@Yantar.ua indicating the settlement account to which the funds should be returned.

All questions that arose during the process of payment and receipt of the Goods can be clarified by the Buyer using the contact information in this section and the contact sections.

10. OTHER CONDITIONS.
10.1. Information about products is presented on the website Yantar.ua
10.2. The buyer agrees to receive promotional materials about promotions, sales, marketing programs, etc., conducted by TM «Yantar Polissia» by means of communication, such as e-mail, mobile communication, including the contact data specified by the Buyer in his profile on the website. In case of unwillingness to receive such information, the Buyer can write a letter of refusal to receive information to the address info@ Yantar.ua
10.3. All disputes and disagreements that arise when the parties fulfill their obligations under this Agreement are resolved through negotiations.
If it is impossible to eliminate them, the parties have the right to apply for judicial protection of their interests.

By accepting the terms of this offer, you also give your consent to the processing (registration, accumulation, storage, adaptation, modification, restoration, use and destruction without your presence) of your personal data throughout during the existence of Yantar.ua, according to the Law of Ukraine "On Personal Data Protection".
